(October 24, 2003) � Draft legislation to
reauthorize funding of the nation�s transportation program. Among other things,
this draft includes provisions to amend the transportation conformity program
under the Clean Air Act and the Congestion Mitigation and Air Quality
Improvement program (see Sections 1612-1621).

Resolution Regarding Nonroad Diesel Rule Adopted by USDA Agricultural Air
Quality Task Force (October 6, 2003) -- This resolution requests that
the U.S. Department of Agriculture be directly involved with EPA in the
promulgation of the final version of the nonroad diesel rule, and this
involvement should include consultation on the proposed rule's impact on farming
and ranching operations, and the agricultural sector as a whole. The USDA
Agricultural Air Task Force adopted this resolution at its meeting in August
2003.

- Motions for Judicial Review and Modification of Consent Decrees (July 3, 2002) -- On July 3, 2002 Caterpillar, Inc. and Detroit Diesel Corporation filed motions in the U.S. District Court for the DC Circuit for judicial review and modification of their respective heavy-duty diesel consent decrees. In their respective motions, Cat and DDC claim the consent decrees are no longer in the public interest and seek to suspend the requirement for compliance with the pull-ahead engine standards by October 2002. Cat�s motion further challenges EPA�s certification several months ago of a Cummins engine (the first engine to receive certification under the consent decrees), as well as the nonconformance penalties that a noncompliant engine maker will have to pay beginning October 2002. EPA's Federal Register Notice of Availability for the Tier 2 Offset Guidance (July 12, 2000) -- This document contains EPA's Draft Guidance on the Use of Emissions Reductions From Motor Vehicles Operated on Low-Sulfur Gasoline as New Source Review (NSR) Offsets for Tier 2/Gasoline Sulfur Refinery Projects in Nonattainment Areas (65 FR 43009). According to EPA, the purpose of the draft guidance is to help state and local permitting authorities understand the proper use of Tier 2 motor vehicle emission reductions as NSR offsets for refineries applying for major NSR permits. Many refineries are expected to need such permits in order to make the changes necessary to comply with the Tier 2 requirements for production of low sulfur gasoline. Comments on the draft guidance, which are being coordinated by STAPPA and ALAPCO's Permitting Committee, must be submitted to EPA by not later than August 11, 2000.

Request for Proposals on Diesel Construction Equipment Project (5/99) - EPA's Office of Mobile Sources is seeking proposals for a project to collect local activity data on diesel construction equipment (e.g., engine populations; hours of use by year, season and day; average power levels; load factors; and fuel consumption) for the purpose of improving estimates of local emission inventories and developing more practical methods states and localities can use to quantify local activity of diesel construction equipment. EPA has set aside $300,000 of Section 105 funds in FY 1999 for this effort. To review a clarification of eligibility requirements, click here. ALA Poll Results (1/99) � Results of a recent American Lung Association (ALA) poll, which reveal that Americans strongly favor national uniform clean-gasoline standards and are willing to pay more for cleaner gasoline if it means cleaner air. The poll also shows that Americans strongly support the same strict emission standards for SUVs and minivans as for passenger cars and that diesel vehicles should be subject to the same standards as gasoline vehicles. Statement of Lang Marsh (OR) on Tier 2 and Sulfur in Fuels (12/14/98) -- Statement delivered during state environmental commissioners' meeting with EPA Administrator Carol Browner.
- In Fall 1998, EPA and the Department of Justice proposed settlement agreements with seven heavy-duty diesel manufacturers alleged to have illegally used "defeat devices" on heavy-duty diesel engines to alter the emission control systems for NOx, thus resulting in millions of excess tons of NOx emissions. Among the fines levied in the proposed settlement are $109 million for environmental projects. State and local air agencies are eligible to apply for these funds. EPA has provided the following information regarding the application process. Please note that the deadline for applying for these funds was January 12, 1999 (extended from December 1, 1998).
