NTE Model Rule

In November 2000, NACAA (formerly STAPPA and ALAPCO) launched the Multi-State Clean Diesel Initiative to facilitate states' efforts to exercise their authority under Section 177 of the Clean Air Act to opt in to California's not-to-exceed (NTE) requirements for new onroad heavy-duty diesel engines. As part of this Initiative, NACAA developed a model rule and related information to assist states in adopting NTE requirements. In 2003, the Institute for Government Innovation at Harvard University's John F. Kennedy School of Government named the NACAA Multi-State Clean Diesel Initiative as one of its 15 finalists for the prestigious Innovations in American Government award. Under this very successful Initiative, 13 states across the nation opted in to California's requirements, resulting in a de facto national standard.
